RHODE ISLAND ≠ THE FEDERAL FLOOR

The rules that are Rhode Island’s own.

Federal cases set the minimum. Rhode Island’s courts have their own answers — and those are the ones that control your stop, your search, your report.

RHODE ISLAND SUPREME COURT · 1992

State v. Werner

Under the automobile exception, probable cause alone supports a warrantless vehicle search under both the Fourth Amendment and Article I, Section 6; no separate exigency showing is required, even for a vehicle in police custody. (615 A.2d 1010 (R.I. 1992)). Scope: Controlling Rhode Island authority within the facts and issue stated in this record.

RHODE ISLAND SUPREME COURT · 1980

State v. Halstead

An investigatory vehicle stop is valid only when the officer can articulate objective facts amounting to reasonable suspicion of criminal activity; a related inventory search of the arrestee’s effects in the vehicle is permissible. (414 A.2d 1138). Scope: Controlling Rhode Island authority within the facts and issue stated in this record.

RHODE ISLAND SUPREME COURT · 2000

State v. DiStefano

Rhode Island statutes do not authorize a search warrant to obtain chemical-test evidence from a DUI suspect; consent is required to make blood-test results admissible, even in a DUI-death-resulting case. (764 A.2d 1156). Scope: Controlling Rhode Island authority within the facts and issue stated in this record.

FIELD CHECK

CANNOT run directly

Sworn LEO can contact Rhode Island State Police at 401-444-1195 (24/7) to have the tag queried. Response is emailed to official law enforcement addresses. During business hours, RI DMV can authenticate directly.

FIELD CHECK

Year-digit rule (30-day tags)

First digit of tag number MUST match the last digit of the expiration year. 2026 tags start with ‘6’. Exception: tags issued in December (carryover window). Violation = counterfeit or misread.

FIELD CHECK

Rhode Island residents ONLY

RI 30-day tags are issued to Rhode Island residents only. Vehicle owner’s address should be in RI. Some MA dealers issue RI tags — but only to RI residents. Non-RI resident with RI temp tag = the tag is being misused.

The temp-tag scanner is free for verified law enforcement — with or without a subscription. SEE HOW THE SCANNER WORKS →
