Deploying a drug-detection dog that extends a traffic stop is unlawful unless supported by reasonable suspicion of the specific drug crime it investigates. Reasonable suspicion of one crime — like DUII — does not justify extending the stop to investigate a different crime.

State v. Spencer
A driver arrested and in custody for DUII has the right, upon request, to a reasonable opportunity to obtain legal advice before deciding whether to blow. You don’t have to wait forever — about 15 minutes usually suffices — but deny the request and you risk suppression of the breath result.

Voluntary consent alone is NOT enough if you got it by exploiting an unlawful stop or seizure. Evidence from a consent search is suppressed if the consent was the product of prior unlawful police conduct — unless the connection to the illegality is attenuated.
